Media violence consumption increases the relative risk of aggression, analysis shows

ScienceDaily (Aug. 27, 2012) ? As president of the International Society for Research on Aggression (IRSA) and with consent of the organization's elected council, Craig Anderson appointed an international Media Violence Commission last December to prepare a public statement on the known effects of media violence exposure, based on the current state of scientific knowledge.

The Iowa State University Distinguished Professor of psychology appointed 12 IRSA researchers to the commission, including Douglas Gentile, an ISU associate professor of psychology.

The Media Violence Commission's research-based report concludes that the research clearly shows that media violence consumption increases the relative risk of aggression, defined as intentional harm to another person that could be verbal, relational, or physical. The report is published in the September/October issue of the journal Aggressive Behavior.

"Basically, the commission looked at, 'What does the research literature say?'" Anderson said. "In addition, we asked them to make some recommendations, if they chose to do so, about public policy. It really was kind of an open-ended charge."

Members took a fair and balanced look at the research

A well-known researcher on the effects of media on children, Gentile says commission members took a fair and balanced look at all of the existing research to see if they could achieve consensus, and then summarized what they found.

In their report, the commission wrote that aside from being sources of imitation, violent images -- such as scenes in movies, games or pictures in comic books -- act as triggers for activating aggressive thoughts and feelings already stored in memory. If these aggressive thoughts and feelings are activated over and over again because of repeated exposure to media violence, they become chronically accessible, and thus more likely to influence behavior.

"One may also become more vigilant for hostility and aggression in the world, and therefore, begin to feel some ambiguous actions by others (such as being bumped in a crowded room) are deliberate acts of provocation," the commission wrote in the report.

The commission recommends that parents know what media their children and adolescents are using. Rating systems often provide too little detail about media content to be helpful, and in any case, are not substitutes for parents' watching, playing, or listening to the media their children use.

"Parents can also set limits on screen use (The American Academy of Pediatrics recommends no screen time for children under 2 and no more than one to two hours total screen time per day for children/youth 3-18), and should discuss media content with their children to promote critical thinking when viewing," the researchers wrote. "Schools may help parents by teaching students from an early age to be critical consumers of the media and that, just like food, the 'you are what you eat' principle applies to healthy media consumption."

The commission recommends improving media ratings

While most public policy has focused on restricting children's access to violent media, the commission found that approach to have significant political and legal challenges in many countries. For that reason, it recommends putting efforts into improving media ratings, classifications, and public education about the effects of media on children.

"Improving media ratings really has two pieces. One is that the media ratings themselves need to be done by an independent entity -- meaning, not by an industry-influenced or controlled system," said Anderson, himself a leading researcher of the effects of violent media on children. "They need to be ratings that have some scientific validity to them.

"But the other piece is education, and if parents aren't educated -- not just about what the ratings system does, but also about why it's important for them to take control of their child's media diet -- then it doesn't matter how good the ratings system is, because they're going to ignore it anyway," he added.

Anderson hopes the final report will have value to child advocacy groups.

"Having such a clear statement by an unbiased, international scientific group should be very helpful to a number of child advocacy groups -- such as parenting groups -- in their efforts to improve the lives of children," he said.

Family Matters: Mark and Jill | Jill Savage

Last week we introduced our kids to each other. ?I thought today would be appropriate to do the same with ourselves and our spouse (if married).

Mark and I have spent much of the summer gardening, working in our yard, sitting on our porch , and reading. Outside of the Olympics, we?ve rarely had the TV on. ?In fact, we?ve started spending some of our evenings just laying on the couch together reading. It?s a new habit we?re forming?and liking!

We live in a 100-year-old farmhouse we?ve been restoring for the past 15 years. It?s a perfect home for our large family. However, the state of Illinois is in the process of deciding whether they are going to put a bypass highway in our city. After years of study, they?ve determined where it will go and that happens to be right through our house! ?It makes me so sad. Now the state has to determine if they have the money for the project. As long as there?s no money, our house is safe. If they find the money to construct the highway, eminent domain will require us to sell to the state. God tells us to not hang on too tightly to the things of this world?I?m putting that scripture into practice a lot these days!

I serve as the CEO of Hearts at Home, but my home is where my heart is. ?One of the core values of Hearts at Home is family first. That means that most of our volunteers and employees choose the hours they work and where they work. For me, that?s always been home. ?During this school year I?m doing a few days a week at the Hearts at Home office during school hours, but being home most days when the boys arrive home from school is important to me.

Mark is now working construction full-time. SawHorse Homes does ?home repair and renovation from the front door to the back door.? ?He loves what he does and he?s quite good at it. ?SawHorse is his own business. He enjoys self-employment because he can schedule his jobs around the family?s needs.

Real life...doing dishes!

Mark and I are experiencing the truth found in Joel 2:25 that says that God will restore what the locust have eaten. ?God is teaching us many lessons that are restoring and refreshing our relationship. ?In time, we?ll share those lessons with you. For now, we are still learning, processing, adjusting, and healing from a hard season.

Counseling is once again a part of our marriage journey. We?ve always been firm believers in seeking help whether our marriage needs something as small as a tune-up or something as large as a major repair. We are grateful for the wise counsel of the Antioch Group in Peoria.

We celebrated our 29th anniversary in June. ?A little over a week ago was the 30th anniversary of when we met on a blind date! ?It?s hard to believe that it?s been that many years!

Step #1 ? Build rapport with your partner

Because there is always someone else on the other side of the table when it comes to negotiations, that person needs to like you. They need to trust you if you want to walk away with what you want.

How do you get someone to trust you? Here are some tips:

  • Mirror body language. Is your partner leaning back in his chair with his hands folded? Do the same. Is your partner standing with his hands on his hips? Do the same. Is he drinking coffee? Do the same.
  • Look into his eyes. Shady and insecure people avoid eye contact. They stare at the ceiling, the wall or out the window, but rarely look at their partner. This will rob you of trust with that person. Who wants to deal with someone they can?t trust? If you are insecure, then they may try to take advantage of you.
  • Mimic the voice. Is your partner soft spoken? Then lower your voice. Is he a fast talker? Then speed up your cadence. Does he avoid foul language? Do the same. Match speed, tone and flavor to make your partner like you.

Know Both Position and Interest of Other Party

Knowing your partner?s position is one thing. Knowing their interests takes the game to a whole new level. Let me explain.

Position trades in the mechanics of a negotiation: ?I need a house. I only have $90,000 to spend.? Interest trades in the why: ?I just re-located for a job in an economically depressed region of the United States. I have eight children and my wife has cancer.

You, as a real estate agent, are no longer trying to help them buy a house. You are trying to help them make life easier for this struggling family.

Take the time to understand both the position and interests of your clients and you can get what you want.

Get on the Same Page

Failing to reach a satisfying conclusion often occurs because two people are not on the same page. One is thinking about moving into the house right now while the other is crunching monthly mortgage payments and calculating annual taxes.

These two people will not come to a satisfactory conclusion unless they both get on the same page.

If you find yourself in this situation, seek to help that person on their level. Suggest that you will help them think through the numbers, and when you are both satisfied, then you both will talk about moving in.

Overcome Objections with Conditions

Even after all that hard work your partner may still resist closing the deal. One or two red flags still nag at them. You have to alleviate their concerns with a condition.

Fore instance, if your client is holding off on an ideal home (and you?ve already looked at eleven) because of concerns about radon treatment, instead of losing the deal, suggest something like this: ?If we can convince them to pay for the radon test and installation, will you put in an offer right now??

Dr. Stephen Ervin is as vibrant as his day of birth?Mardi Gras. Like the celebratory day itself, Ervin is animated, larger than life, and full of contagious energy. He has spent two decades working at Harvard University teaching courses, speaking at conferences, and authoring books about his passion?the intersection of computing, design, and science. ?Geodesign has taken over my life,? Ervin chuckles.

The Assistant Dean for Information Technology at Harvard?s Graduate School of Design, Director of Computer Resources, and lecturer in the Department of Landscape Architecture, Ervin still somehow manages to find time to evangelize and promote the principles of geodesign in various ways around the world.

?When I first heard the term, I thought I?d been using it all my life,? said Ervin. ?But I hadn?t. There was no geodesign 50 years ago. We finally have the means to go about geodesign with all this digital technology?computers and software and satellites and collaboration tools, apps and smartphones?we have a whole new discipline on our hands.?


A Defining Moment

In Ervin?s opinion, geodesign is something that has been talked about for many years. ?We called it computer-aided design,? said Ervin. ?We didn?t mean CAD?we meant design aided by computation, and that?s really where we are headed.?

One of the defining moments in Ervin?s career was studying in the graduate school at the University of Massachusetts in Amherst, Massachusetts in the landscape architecture program, which introduced? Ervin to computer representations of the real world. ?I saw this image of ski slopes cut into the hills and the forest clearing that were quite primitive graphically; at that time trees were little triangles with sticks,? said Ervin. ?It probably cost days and thousands of dollars for the US Forest Service to produce back in the 1970s. I was drawn to this idea that took bits and bytes and tabular data about tree positions and species and an elevation model and turned it into a visual representation from which decisions could be made.?

The idea that data could be combined with graphical representations was inspirational to Ervin, and shortly after he was introduced to GIS at Harvard University?s Laboratory for Computer Graphics and Spatial Analysis.? In 1984, Ervin took this knowledge and began a software company to help landscape architects visualize the results of design decisions.


The Future of Geodesign

At the 2012 Esri User Conference, Esri president Jack Dangermond presented Ervin with the prestigious Lifetime Achievement Award for his pioneering work in melding together the disciplines of GIS and design.? In presenting the award, Dangermond noted that ?lifetime? didn?t mean that Ervin?s work was done.? There is still much important work to do.

Ervin sees the marriage of science and design as the real challenge to geodesign, so interactions may be orchestrated and we can see the true impacts of design decisions. The idea that people can have visual feedback for decisions?such as with the ski slope representations?has become a fundamental driver to what Ervin finds the most exciting about geodesign. ?The idea of immediate visual feedback and dashboards to display key indicators that tell us how well we?re doing, and in real time, is important,? said Ervin. ?Whether measuring carbon footprint or total costs or total number of houses, cars, people, buses or even elephants?it?s important to have this kind of feedback and in real time.?

Valve Corporation and IceFrog seem to know really well what fans of Defense of the Ancients (Dota) 2. That pretty much explains why they wasted very little time to add Nessaj the Chaos Knight to the hero-roster in the free-for-play action role-playing game (RPG).

Chaos Knight is a strength hero with an ominous presence in the battlefield. He has an advantage over the rest of the heroes in terms of movement speed, which is significantly greater than other heroes even without any movement speed items.

When playing with Chaos Knight, one ends up relying heavily on luck as two of his defining abilities have a random number generation, namely Chaos Bolt and Chaos Strike. At their maximum potential, both the abilities are devastating to say the least, but at other times, they are pretty-much average.

One of Chaos Knight?s most crucial abilities and the reason that he will be picked in a number of games is Chaos Bolt. It is a single-target spell that, when aimed at an enemy, has the potential to stun him for duration of up to four seconds, while dealing damage somewhere in the range of 100-275. This ability is extremely useful in initiating a gank, as well as bringing a feeling enemy to a halt and making him a sitting duck.

Chaos Knight?s second ability Reality Rift has a striking resembles to Rikimaru?s and Phantom Assassin?s Blink Strike, though with one notable difference. Instead of teleporting the hero to the targeted enemy, the ability will move both you as well as the targeted unit towards each other. In addition, the ability will give you a 100 percent damage buff for 1.2 seconds. There is more to the ability that will be revealed when we talk about his ultimate.

His third ability, Chaos Strike, is a critical strike, making it possible for Chaos Knight to deal a huge amount of damage while dealing a physical hit. One thing that makes these images unique from that of Terrorblade or other heroes is the fact that these images deal 100 percent damage, though they will take 200 percent damage. These damages are extremely powerful and can bring down a tower with apparent ease. The ultimate also ends up confusing the enemy by creating a jumble of Chaos Knight look-alikes, grating him a slight advantage in form of deception.

One thing to note is that Chaos Knight?s ultimate has a strong synergy with his other skills, especially Chaos Bolt and Reality Rift. Summoning up to three images at the ability?s maximum level, it will be so much easier to lay an enemy to waste by striking him with Chaos Bolt, preventing him from moving as much as a muscle. Aside from that, the Reality Rift ability moves Chaos Knight as well as his images in the 1400 Area of Effect (AoE) to the targeted enemy in a blink of an eye, instantly bringing him within striking range.

Chaos Knight is indeed a powerful hero to play with, though he is best left for the advanced players.

The Future of Story 2012 Part III: Writing ... - Amy Laurel dot Com

If you have ever felt discouraged while writing, this panel was for you!

Pen Densham (Riding the Aligator) led the discussion joined by Will Akers (Your Screenplay Sucks!), Penny Penniston (Talk the Talk), Diane O?Bannon (speaking for her late husband Dan O?Bannon: Dan O?Bannon?s Guide to Screenplay Structure), Eric Edson (The Story Solution) and Jennifer Dornbush (Forensic Speak).

I have to say, I loved how laid back and open this panel was. Everyone was very frank and eager to encourage those of us in the audience.

When honing your skill as a screenwriter an important place to start, as Penny Penniston pointed out, is ??reading submitted scripts.? Dianne O?Bannon added ?read both good and bad screenplays! It will give you so much experience.?? Having taken this advice from others in the past, I can tell you it is so helpful! A great place to find screenplays online is Simply Scripts. Jennifer Dornbush urged us to collaborate, ?be part of a writers group? she said. Read the work of your peers as well as work that has made it onto the screen. The more screenplays you read the more comfortable you will be in that environment.

So, what happens when you aren?t feeling it? ?You can?t wait for your Muse? warned Diane. Eric Edson actually encouraged ?Write badly with pride!? Pen Densham calls a first draft the ?Lewis & Clark draft. Any fucking way to the coast works!? I laughed and silently thanked them for giving me permission to write a crappy first draft. Let?s face it, no one likes their first draft anyway, why not give yourself permission, as they said, to just let it be junk. The key is to finish your first draft.

So, you have a first draft, now what? Will shared his thoughts on writers block and rewrites, ?if you can write yourself into a hole you can write yourself out of the hole.? Eric explained ?approach screenwriting because you can?t help yourself. If that statement is true of you, then you have already won!? I adore that sentiment because you will keep coming back to the story, you will keep tweaking and editing until you have a work you love. ?The films that nagged me had more story ?muscle?.? Pen confided. He had so many wonderful words of wisdom ?Be daring, be dangerous, don?t try guessing what people want you to write!?

When this panel was over it was hard not to grab a laptop and just leap into my work! Although, Will Akers also cautioned ?Don?t give your story to someone before it?s ready.? Sensible words indeed! He said to ask yourself ?What can I do to make this better?? This was about the time writers groups came up again. Get feedback, use script consultants, ask for feedback from people who are likely to tell you the truth versus what they think you want to hear.

In my humble opinion using a professional script consultant is one of the smartest things you can do for yourself. You know that they will be straight up with you and you know they have the experience to back up their words. Each of the authors on this panel came out and directly said that if you reach them via their websites they will answer any reasonable questions you have about screenwriting. Many of them also work as consultants (this is true of most of the authors I have blogged about in the last few days). On Tuesday, United added $10 per round trip to base fares for flights longer than 500 miles. On Friday, United and other big airlines had matched Southwest Airlines Co.'s increase of $10 per round trip on shorter flights.

"United appears to be probing other airlines' appetite after the swift matching of the limited scope increase by Southwest Friday," said Rick Seaney, CEO of air-travel website FareCompare.com.

Wall Street likes it when airlines raise prices. Airline stocks rallied Monday when it became apparent that the Southwest fare hike would stick, and several gained again in Tuesday afternoon trading.

Shares of United Continental Holdings Inc. gained 12 cents to close Tuesday trading at $19.58; Delta Air Lines Inc. added 25 cents, or 206 percent, to end at $9.70; Southwest added 4 cents to $9.48; and Alaska Air Group Inc. rose 6 cents to $34.83.

US Airways Group Inc. was helped by a comment from the CEO of JetBlue Airways Corp., who said his company wasn't interested in a merger. The comment was seen as raising the chances for a merger of US Airways and American Airlines parent AMR Corp., a deal that US Airways has been pursuing for months.

JetBlue shares ended unchanged at $5.27.

Military Surveillance Balloons Head Stateside

Some of the equipment from the wars in Iraq and Afghanistan is no longer needed and will be deployed in Texas to assist U.S. Customs and Border Protection, KGRV.com reported on Aug. 10. Blimp-like balloons, called aerostats, will be used to monitor the ranchlands of the western Rio Grande Valley.

"This is Department of Defense equipment that we are testing and evaluating ... to see what kind of utility it may have in regards to border enforcement," Border Patrol Agent Enrique Mendiola said. "Anytime you can acquire this type of technology or any type of equipment as a force multiplier, it's always welcomed.?

The aerostats, which have cameras that can see 360 degrees, will be tested for several months. ?Aerostats? primary advantages over other platforms capable of providing elevated, persistent surveillance (manned aircraft and UAVs) appear to be low life cycle cost and long dwell time,? according to a 2006 report by the Congressional Research Service titled Potential Military Use of Airships and Aerostats.

NCAA falls under even more scrutiny

Charges of academic fraud at North Carolina may ultimately cast more of a searing light on the NCAA than the school where the alleged wrongdoing occurred.

And Penn State fans aren?t the only ones waiting to see if NCAA president Mark Emmert takes action following a recent show of muscle in University Park that left him open to charges of hypocrisy.

?The NCAA has conducted investigations and imposed penalties in similar cases of academic fraud, so I find it curious that the NCAA decides not to intercede in this instance,? said Michael Buckner, a South Florida-based attorney whose law firm represents colleges and individuals in NCAA cases.

Emmert has not indicated whether his organization will discipline North Carolina despite charges that athletes took no-show classes over a five-year period ? one that overlapped with an NCAA investigation of the school for academic impropriety.

Yahoo columnist Pat Forde wrote last week that the NCAA has to do more than just show it can ?hit a bloated target at close range,? his characterization of the punishment Emmert meted out at Penn State for the Jerry Sandusky child sex abuse scandal. Buckner wondered how the NCAA could exceed its jurisdiction with a criminal matter at Penn State but allow North Carolina to handle a widespread cheating scandal internally.

NCAA brass did not return a phone message late last week seeking comment.

?It goes back to my original concern and complaint at how the NCAA treated Penn State, that now it?s going to be up to the judgment of Emmert to decide (whether an issue) violates what he calls the core NCAA principles of morality, honesty, sportsmanship and ethics,? Buckner said. ?I don?t think the membership appointed Emmert dictator or, even a lesser term, the commissioner of the NCAA.?

Emmert, with the backing of an executive board composed of college presidents and chancellors, levied unprecedented sanctions against Penn State for what he called a football culture run amok. The NCAA used the Penn State-commissioned Freeh Report as the basis for sanctions that included a
$60 million fine and a loss of football scholarships.

Cedric Dempsey, a former executive director of the NCAA, said he didn?t have a problem with the punishment because of the heinous crimes committed by Sandusky, a former assistant football coach, while Sandusky still had access to Penn State facilities.

Dempsey did have concerns, however, with how the NCAA arrived at that punishment.

The executive branch usurped the judicial branch, even though the two are supposed to have equal power alongside the legislative branch. The NCAA has been criticized in the past for not acting quickly or boldly enough to discipline schools that run afoul of the rules, but Emmert achieved both in punishing Penn State.

?I do think, at times, there needs to be a process that expedites decision-making a little bit more, and I think they?re working on that right now,? said Dempsey, the NCAA?s executive director from 1994-2003. ?At the same time, I hope we don?t disrupt what has been a reasonably effective process over the years except for the delay and length of time it takes sometimes in decision-making. I?d hate to see us lose the judiciary aspect of the association.?

The lack of due process afforded to Penn State by the NCAA has resulted in a disconnect between a significant segment of alumni and leadership that wants the embattled school to move forward. The board of trustees has stood behind university president Rodney Erickson despite a few of its members? opposition to the sanctions to which Erickson consented.

One of the more bellicose voices in standing up to the NCAA belongs, coincidentally, to a Pitt graduate who was unsuccessfully recruited by former Nittany Lions coach Joe Paterno in the late 1960s.

Ralph Cindrich, a Carnegie-based lawyer and NFL agent, said the sanctions are unlawful and will have negative repercussions for the state.

?This school and the people didn?t deserve it, and to talk the way (the NCAA does) about the school and the program to me is just too far from the truth and reality of what goes on,? Cindrich said. ?The fraud that (the NCAA perpetuates) of amateurism is just astounding to me.?

Cindrich is examining ways he can get the NCAA into court, and he said he has talked to high-profile Penn State alumni in the area about legal action.

?I?ve never seen anything as wrong as this,? Cindrich said, ?and that?s what bothers me.?

ESPN college football analyst Todd Blackledge said the NCAA raised the stakes when it punished Penn State ? as well as expectations for disciplining schools that commit major rules violations.

?I think everybody?s going to be looking at everything that comes after that because what the NCAA chose to do in the case of Penn State was clearly unprecedented, and there were some of us that would think it was probably extreme,? said Blackledge, a former Penn State quarterback. ?I think there will be a lot of people that will be paying attention to what the NCAA does from here on out.?

Jerusalem police arrest suspects in anti-Arab attack

Jerusalem police on Sunday arrested three Jewish teens suspected of a brutal hate attack on young Palestinians, and magistrates remanded in custody another suspect detained a day ago.

"Altogether four people have been arrested,' police spokesman Micky Rosenfeld told AFP.

"The latest three people to be arrested are youths between the ages of 13 and 17. They are being questioned and the investigation is continuing."

He said that the 19-year-old arrested on Saturday appeared in court on Sunday and his remand was extended.

Local media said he denied taking part in the assault in the early hours of Friday on four cousins from Israeli-annexed east Jerusalem, in which 17-year-old Jamal Julani was seriously hurt.

"We were walking and suddenly maybe 50 Jews came toward us shouting 'Arabs, Arabs,'" one of the cousins, Mohammed Mujahad, who was only slightly injured, told Haaretz newspaper.

"Jamal tried to run but (the attacker) hit him in the chest and he fell, with his head on the ground," another cousin, Nuaman Julani told the paper.

The incident took place at Jerusalem's central Zion Square, a busy late-night meeting place in the heart of the city's bar and entertainment district.

In a culture where litigation is commonplace, business owners have many more worries than making profits and retaining top employees. If your product injures a consumer, your organization could face a devastating lawsuit, exponential damages and a tainted reputation in the marketplace. To assist with the financial burden of a claim, many business owners purchase commercial umbrella insurance on top of their standard Commercial General Liability (CGL) insurance policies.

Most CGL policies have an aggregate limit that, once exhausted, will not cover any other excess claims. Experienced business professionals understand that the litigious nature of our society combined with surmounting liability judgments are reason enough to purchase additional coverage.

Over the years, courts have reached multimillion-dollar verdicts as the result of the following: a grain elevator explosion in which an individual suffered severe burns in Ohio; the use of a chemical inaccurately labeled as animal feed in which thousands of livestock died in Michigan; and a commercial truck accident in Florida in which many people lost their lives.

Businesses are also liable for the health and safety of their employees and for their employees? behavior. For instance, your business could be held liable after your holiday party results in property damage to a rented banquet hall. You may also face litigation if your business office has a carbon monoxide leak that causes a number of employees to get extremely ill. To protect?against an unforeseen claim similar to these, commercial umbrella insurance protection is a must.

Purpose of Umbrella Coverage

Umbrella coverage is designed to protect an organization against monumental liability claims that can demolish a business through a large financial judgment. Typically, an umbrella policy serves the following purposes:

  • Provides coverage for potential damages and court defense courts that exceed underlying insurance policies (typically CGL policies).
  • Provides coverage in situations that are not covered by underlying insurance policies but are not excluded from the umbrella policy. This benefit is subject to a self-insured retention (SIR), similar to a deductible, in which the policy holder is responsible for losses up to the SIR amount.
  • Applies to claims where the aggregate limit of the underlying policy has been met. The umbrella policy will cover the portion of the claim that cannot be paid with the underlying policy because there are not enough funds available in the policy to cover the entire claim. For instance, if at the time of a claim your CGL policy has $500,000 remaining and the claim in question is $1.5 million, then the CGL policy will cover $500,000 and then the umbrella policy will cover the remaining $1 million.

Coverage Details

A typical umbrella policy has the following features:

  • Offers coverage for worldwide; personal injury; blanket contractual liability protection; care, custody and control; non-owned aircraft liability; watercraft liability; advertisers liability; liquor law liability; and XCU liability.
  • Offers an extension of insurance protection for additional insureds.
  • Policies follow form, meaning they abide by similar provisions and cover similar losses as the underlying policy. If claims are not covered by an underlying policy, the umbrella policy makes the business responsible for the loss if it exceeds SIR limits. The damage must also involve personal injury, property damage or advertising injury.
  • The insurer has the right to investigate all claims not covered by any underlying insurance.
  • Policies either cover all individuals or cover parties that gain insured status within the contract. Policies also protect an organization?s executive officers, regular employees, directors and stockholders acting on behalf of the organization. Protection for additional insureds in typically excluded when claims involve motorized vehicles, watercrafts and aircrafts.

Beyond these stipulations, a commercial umbrella policy ascertains that an organization must hold an underlying insurance policy during the term of the policy.

Steve Jobs' stolen iPad unwittingly used by local clown after burglary

What would you do if you had Steve Jobs' iPad? Kenny the Clown, who had the late Apple (AAPL) co-founder's tablet all to himself for a few days this month, didn't play any games, surf the net or check for any top-secret corporate documents.

Instead, he loaded iTunes to play the "Pink Panther" theme song and Michael Jackson, using the magical device to entertain Bay Area kids and tourists during his clown routine.

He had no idea the device came from the fabled Jobs residence until after the friend who gave him the gadget was charged with breaking into the CEO's Palo Alto home. By then, the cops had already shown up at his door and taken it away.

"It would be like getting a football from Joe Montana that was stolen out of his house," said the 47-year-old professional clown, whose real name is Kenneth Kahn. "It's bizarre; it's really bizarre."

Police said Kariem McFarlin, a 35-year-old Alameda resident, gave Kahn a silver 64GB iPad that was stolen out of the Waverley Street home on July 17. McFarlin also allegedly gave another iPad to his daughter, and both devices were returned to the Jobs family after McFarlin was arrested on Aug. 2, police said.

McFarlin is accused of stealing iPods, Macs, Tiffany & Co. Jewelry,

and even Jobs' wallet and driver's license by using a spare key he found on the property to break into the home, which was under construction. The heist has sparked international media attention since being revealed by this newspaper late Monday.

Kahn had played around with plenty of iPads at Apple stores and thought he had just gotten an old device McFarlin wanted to get rid of, assuming his friend had purchased a newer-version iPad.

"I didn't notice anything special or anything like that," said Kahn, adding he had the iPad for three or four days before police asked for it back. "It was silver; it looked normal. I was basically using it like an iPod."

Kahn -- who unsuccessfully ran for mayor of his hometown Alameda in 2006 and 2010 and for San Francisco mayor in 2007 -- met McFarlin when he coached him on the Encinal High School basketball team in Alameda more than 10 years ago, and they remained close.

He said McFarlin is not "any type of menace" and before the story hit the news, his friends figured it was a case of mistaken identity.

"He's a nice guy who made a horrible, horrible decision," Kahn said. "I wish I could ask him: 'What were you thinking?'"

McFarlin is due in court Monday where he will be represented by a recently hired private attorney. The public defender's office, which is still officially representing McFarlin, declined to comment and said McFarlin's new attorney wants to remain anonymous until Monday's hearing.

Court records show McFarlin pleaded guilty in Santa Clara County Superior Court in 1999 to driving without a license, a misdemeanor that netted him fines and a year of probation. The former San Jose State football player was also arrested by Pleasant Hill police last year on suspicion of stealing but prosecutors never filed charges.

"Before the public sees him as this horrible monster, I'd like to hopefully think we can somehow get across that he just made the worst mistake of his life," Kahn said.

McFarlin, who police say confessed to the crime, remained in jail Thursday in lieu of $500,000 bail. Apple and the Jobs family have declined to comment.

"It still hasn't really 100 percent set in for me. It was Steve Jobs' iPad -- literally," Kahn said. "If this thing weren't so tragic, it would be comical."
